Bryan J Heaney

Bryan Heaney has experience of litigation in many areas in both the civil and criminal courts. He has developed particular interests in the law relating to the recovery of the proceeds of crime and in employment law. In 2005 he was appointed Standing Junior Counsel to the Scottish Ministers and has gained experience appearing on their behalf. He is the Scottish reporter for the Times Law Reports.

The broad range of his practice is demonstrated by the following list of some of the cases in which he has appeared:

  • Hughes v Grampian Country Foods Group Ltd, 2007 SLT 635 - appeal to the Inner House on the interpretation of the Manual Handling Operations Regulations 1992
  • Scottish Ministers v Buchanan, 2007 SCLR 301 - proceedings for a recovery order under the Proceeds of Crime Act 2002
  • T Millar & Sons v Scottish Ministers, 2006 SLCR (2) 200 - an appeal to the Scottish Land Court in an case concerning the interpretation of the European Regulations governing the Suckler Cow Premium Scheme
  • Bryceland, petitioner, 2006 SCCR 291 - criminal appeal on the basis of apparent bias
  • Glasgow Housing Association v Sharkey, 2005 SLT (Sh Ct) 59 - the leading Scottish case on the test to be satisfied before imposing an Anti-Social Behaviour Order
  • HM Advocate v McIntosh  2002 SCCR 287 - one of the rare proceeds of crime case which has run to proof
