Ruth M Innes

Ruth specialises in family and child law. She is instructed in cases both in the Court of Session and in the Sheriff Court involving all aspects of financial provision on divorce, financial claims on breakdown of cohabitation or on the death of a cohabitant, pre-nuptial agreements, child abduction, relocation of children, jurisdiction in cross-border proceedings, adoption and parental responsibility orders. She has been involved in a number of reported cases including:

  • Carroll v Carroll 2005FamLR 99 residence; whether there was emergency jurisdiction in respect of a child removed from England
  • H v H 2006 FamLR 59 child abduction; whether the defence of consent to an application for return of a child was established
  • Clark v Clark 2006 FamLR 90 financial provision on divorce; whether an order for sale of assets of a farming partnership ought to be recalled

Ruth has delivered seminars on a number of topics in the field of family law. She is a Reporter for Session Cases and edits the chapters on Cohabitation and International Aspects of the Law relating to Parental Rights and Responsibilities in Butterworths Family Law Service.
