Andrew Hajducki QC‘s article “A pattern of awards – juries and the bereaved” is published today.

Andrew summarises the awards made over the last ten years by judges and juries for the loss of a relative in terms of section 1(4) of the Damages (Scotland) Act 1976, as amended. He suggests that given the significant sums awarded in recent jury trials, which have been substantially in excess of awards by judges, the time has come for judges to re-assess the position when making their own awards. In addition, awards by juries for the loss of children have overtaken awards for the loss of a husband or wife.
