Greg successfully defended a liquidator’s claim that a property purchase transaction pre liquidation was a gratuitous alienation in terms of section 242(4) of the Insolvency Act 1986. The court held that the price paid in a “distress sale” was adequate but neverthless held that the action was necessary as at the start of the proof the full agreed purchase price had not been paid as contracted.
