Prior to calling to the Scottish Bar in 2021, Emily was a barrister in England and Wales, called in 2009. She comes to the Scottish Bar with 11 years of experience in court advocacy, having specialised in family law for the last seven years.
Emily enjoyed a busy practice in England and Wales, instructed in all aspects of family law and child law. She has been instructed in actions for financial provision following the breakdown of relationships, representing high net worth clients with cases involving farms, trust structures and overseas assets. She has dealt with applications for emergency orders to protect assets and with cases involving financial misconduct. She has a wealth of experience in negotiating settlements in financial provision cases.
Within private child law, Emily regularly dealt with sensitive and complex issues surrounding parental alienation, changes of residence, relocation, removal from the jurisdiction, poor mental health, drug and alcohol addiction, and domestic abuse.
In public law, Emily was instructed in cases involving domestic abuse, sexual abuse and non-accidental injuries to children. She has represented local authorities, parents, and children in all levels of court. She has experience representing parents who lack capacity through the Official Solicitor. She has experience in dealing with complex medical evidence and expert opinion and in cross-examining a wide range of experts. She was instructed in cases involving international jurisdictional issues and applications to deprive children of their liberty.
Emily has a keen interest in human rights law and cases involving arguments on convention rights. Prior to specialising in family law, she gained some experience in employment law, personal injury, crime and cases in the Court of Protection.
Emily has spent time shadowing with Rachel Shewan, Isabella Ennis, Alison Wild, Lynda Brabender QC, Janys Scott QC and Lady Wise to gain experience and insight into Scottish family law proceedings.
Since calling to the Scottish Bar she has been instructed in proofs in relation to children’s matters and financial provision upon divorce, she has conducted hearings in both the Sheriff Court and the Court of Session, including those dealing with emergency protective orders. She has appeared in the Employment Tribunal in cases involving disability discrimination. She has been instructed in cases involving overseas clients, intra-UK jurisdictional issues, allegations of parental alienation, domestic violence, and child abuse. She has advised in a wide range of subjects including The Human Fertilisation and Embryology Act 2010 and the Hague Convention.
Emily is a committee member of the Junior Bar Association, a committee member of the Faculty’s Law Reform Committee and the Treasurer of AFLA.
