Westwater’s Duncan Milne appeared for the respondent in the recent case of Carson v WC In Fields. The case concerned a claim for unfair dismissal alleging that redundancy was not the real reason for dismissal and the respondent acted unreasonably in putting the employee in a pool of one.
Finding for the respondent, EJ McCluskie dismissed the claim. The respondent had genuinely applied its mind to the pool and there had been a long-term downturn in work undertaken by the employee due to coronavirus.
