Westwater Advocates’ David Anderson acted as junior counsel to the Dean of Faculty in the case of Mack v. Standards Commission for Scotland.
The case concerned a local authority councillor who had been disqualified from holding or being nominated for office for a period of time which meant that he could not stand for election in the May 2022 local government election.
In a written opinion the Second Division of the Inner House held that the sanction imposed on the appellant was excessive and reduced the period of disqualification to a period which allowed the appellant to stand for election in May.
