The case of AM v RM was the first case in Scotland to consider the question of whether or not a parent who has had parental rights and responsibilities removed by order of the Court in a Part 1 order under the Children (Scotland) Act 1995 has title to seek an award of contact.
In her judgement, Sheriff Sinclair in Paisley Sheriff Court considered that the terms of section 11 (3) (ab) were clear and unambiguous and removed title to seek contact to a child from the class of people into which the Pursuer in the case fell. In doing so, she was agreeing with Professor Norrie and his views expressed in his latest edition of “The Law Relating to Parent and Child in Scotland” @ pages 276 and para 8.37.
