In this Appeal from the Sheriff Court Greg Sanders appeared for the pursuer and respondent. The Inner House refused the defender’s appeal in a dispute relating to the rights and liabilities of proprietors for the cost of common repairs to a flatted villa.
The case provides useful guidance on (i) Time Bar under the Summary Application Rules and (ii) the Tenement (Scotland) Act 2004, including commentary on the construction, interpretation and application of the 2004 Act in relation to “tenement”, “scheme property”, maintenance and access.
